Reaching 12 points (totting up)
At Libra Solicitors we believe that it is never too early to take legal advice, but sometimes, it can be too late. In respect of ‘totting up’, our expertise could help you keep your licence.
If your licence is endorsed with 12 or more points in a 3 year period the court will, because of the ‘totting up’ rule, have to consider imposing a mandatory 6 month ban. This does not mean that you will automatically lose your licence. If a successful ‘exceptional hardship’ argument can be put forward, the court has the discretionary power not to impose the ban.
However, there are no concrete rules as to what amounts to exceptional hardship, and there is no guarantee that any argument put forward to the court will be accepted. If your argument does not convince the court that exceptional hardship will occur if you lose your licence, the court will impose the ban.
How we can help
At Libra Solicitors we are committed to giving you clear, practical advice that you can use and we can help you determine whether in your case, an exceptional hardship argument exists. If we believe such an argument exists, we will advise you accordingly and where possible, help you obtain documentation and written witness statements that support your argument. We will then skillfully prepare a persuasive argument to put forward to the court.
Our expertise could help you keep your licence and as your case will be led by barrister or a solicitor-advocate, you can be sure that the advice we give you and the representation at court that we provide, will be of the highest quality.
Whilst we are committed to putting forward the best ‘exceptional hardship’ argument possible on your behalf, there is no guarantee that the court will accept it. However, if your ‘exceptional hardship’ argument be accepted by the court you will keep your licence.
