Your intellectual property

At Libra Solicitors we believe that how your business develops, markets, protects and generally uses any intellectual property (IP) it owns, could be crucial to ensuring its continuing success. Your IP is a usable asset that can be bought, sold, licenced and assigned and proper management of your IP portfolio, could give your business a competitive advantage in the marketplace.

We appreciate that maximising the value of your IP is a priority for you or your business and we can help you achieve your goals. Once we have identified the IP that you or your business owns, we will give you clear, practical advice in how best to unlock its value. Whether we are negotiating the terms of a licence with another party, or are assisting your business with strategic planning so that your IP is utilised at the right time and in the right location, you can be sure that we are committed to helping you reach your objectives.

We can also help protect your IP rights by drafting bespoke confidentiality agreements and licencing contracts, within which we will incorporate a level of protection tailored to your specific, individual needs. Trademarks

Infringement of your IP by unauthorised parties could damage your business’s reputation, so it is crucial for your business to take a proactive approach in preventing any unauthorised exploitation.

One way to do this is to register a trademark in respect of the goods and services your business provides, as it will afford those goods and services legal protection from infringement and unauthorised exploitation. Trademarks can last a lifetime, however, as they have to be renewed periodically, they need to be properly managed to ensure they do not lapse or deteriorate.

A registered trademark can also add commercial value as it provides identity and can distinguish the goods or services your business provides, from those of your competitors. Trademarks therefore should be considered valuable assets and at Libra Solicitors, we can help you unlock the hidden potential of the trademark you own.  For a confidential discussion about your trademark needs, please call 01223 632420 and arrange an appointment.

Unfortunately infringement of your IP rights could still place even after you register a trade mark. If you believe your trademark rights have been infringed, talk to us. We will give you clear, practical, advice that you can use and we can act quickly to stem the potential damage to your business and help you recover any losses you may have incurred.

At Libra Solicitors we believe protecting your IP should be a priority. For a confidential discussion in respect of protecting call us on 01223 632420 and arrange an appointment.

Patents

At Libra Solicitors we believe that when it comes to patents, it is crucial that confidentiality be maintained, at least until the patent has been granted. Once the patent has been granted, the owner of the patent has legal rights in the patent that can be protected and enforced if infringement takes place.

As registered patents are considered usable assets, they can be bought sold or licenced out under agreed terms. However as patents are granted territorially, protection from infringement and enforcement of the owner’s rights occurs only in the geographical location in which the patent was filed and then granted. Strategic planning to maximise the patents value before the filing of the patent in any country is, therefore, essential.

At Libra Solicitors we can help you unlock the potential of the patents your business owns. Whether we our using our expertise to negotiate the right licensing deal, or drafting non-disclosure agreements (NDAs) to help prevent a breach of confidentiality, we are committed to helping your business achieve its commercial goals.

Unfortunately, infringement of your IP rights could still place even after your patent has been granted.  To limit the risk of this happening we can help you implement a defensive strategy designed to prevent the exploitation and infringement of your patent by other parties. Should infringement occur, we can act quickly to stem the damage to your business and could make a persuasive application for interim relief. We could also help you recover any losses you may have incurred.

We understand that maximising the value you or your business obtains from the copyright your business owns, is a priority and our expertise could help you.

From establishing ownership, which can prove to be contentious, to negotiating terms and drafting licensing agreements, we will give you clear, practical advice that you can use. We can also help you with strategic planning and manage your IP portfolio so that the true value of copyright is properly realised.

Should the rights you possess in the copyright you own be infringed, we can act quickly to help protect your interests and limit the damage to your business. We could also help your recover any financial losses your business suffers.

Design rights

Design rights can exist both through registered and unregistered rights. Registered designs allow the appearance of a product to be protected and grant the holder exclusivity in the commercial exploitation of both the product and the design. Registering the design also allows the owner to prevent other parties from exploiting the design.

Unregistered design rights are automatic within the UK, and provide protection from copying for a limited period. However, they do not grant exclusivity in the use of the design and the design must be original and uncommon in order to be given protection. At Libra Solicitors we recognise that maximising the commercial value of the IP your business owns is a priority for your business.
